Digital Optometry Solutions is the trading name of DIGITAL OPTOMETRY SOLUTIONS (Pty) Ltd (Registration No. 2026/534959/07) (“we”, “us”, “our”), a company registered in the Republic of South Africa. We build Software-as-a-Service (SaaS) products for optometry practices, currently including DryCheck, MyoTrack, LensGuide, ColourCheck, Eating for Your Eyes, the Practice Growth Hub and the Prescription Visualizer (together, “the Services”).
By registering an account or subscribing to any of the Services, you (“the Subscriber”, “the Practice”, “you”) agree to be bound by these Terms and Conditions in full. If you do not agree, do not use the Services.

The Services are available exclusively to registered optometry practices and licensed optometrists operating in South Africa. By subscribing, you confirm that your practice is legally registered and operating in accordance with South African law, that you are authorised to enter into this agreement on behalf of your practice, and that all information provided during registration is accurate and complete.
Each Service is offered as its own monthly subscription, per practice, billed monthly in advance in South African Rand: DryCheck R499.00, LensGuide R299.00, MyoTrack R199.00, ColourCheck R99.00, Practice Growth Hub R99.00, and Eating for Your Eyes R49.00 per month. The Prescription Visualizer is included at no charge with any active subscription and is not sold separately. Prices exclude VAT where applicable and may change on reasonable notice.
Where a free trial is offered (currently a 14-day free trial for DryCheck), no payment is taken during the trial. At the end of the trial the subscription activates automatically and the first payment is processed. Continued use of a Service after any trial constitutes acceptance of these terms and authorisation for recurring monthly billing.
All payments are processed securely through Payfast, a licensed South African payment processor. We do not store your card details.
You agree to use the Services only for their intended purpose within your registered optometry practice. You may not share access credentials with individuals outside your practice; use any Service to process patient data for purposes other than clinical eye care; attempt to reverse-engineer, copy or redistribute any part of the software; or use the Services in a manner that violates any applicable South African law or regulation.
Patient data collected through the Services is processed in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). Your practice is the Responsible Party for patient data captured through your practice's links and accounts; we act as the Operator processing that data on your behalf.
You are responsible for ensuring that patients have been informed about, and where required have consented to, the collection and processing of their health information. Where a Service collects patient information, a patient-facing consent notice is provided as part of that Service.
Data is stored on encrypted servers in the European Union (AWS eu-central-1, Frankfurt). Data is not sold or shared with third parties.
We endeavour to keep the Services available at all times, but do not guarantee uninterrupted access and accept no liability for downtime caused by scheduled maintenance, third-party infrastructure or circumstances beyond our control. We may update, modify or discontinue features with reasonable notice to subscribers.
All software, content, branding and materials in the Services are the intellectual property of DIGITAL OPTOMETRY SOLUTIONS (Pty) Ltd. Your subscription grants a limited, non-exclusive, non-transferable licence to use the subscribed Services for your practice. No ownership rights are transferred.
The Services are clinical and business support tools and do not constitute medical advice or diagnosis. Optometrists remain fully responsible for all clinical decisions, including decisions informed by screening scores, progression verdicts, visualisations or educational content provided through the Services.
To the maximum extent permitted by South African law, our total liability to you for any claim arising out of or in connection with these terms shall not exceed the total subscription fees paid by you in the three months preceding the claim.
Either party may end a subscription at any time in accordance with our Refund and Cancellation Policy. We may suspend or terminate your account immediately if you breach these terms, fail to make payment, or engage in conduct that poses a risk to other users or the Services.
These terms are governed by and construed in accordance with the laws of the Republic of South Africa, and any disputes are subject to the jurisdiction of the South African courts.
We may update these Terms and Conditions from time to time. Subscribers will be notified of material changes by email, and continued use of the Services after notification constitutes acceptance of the updated terms.
